Currently in private law practice, Bob has devoted virtually his entire career to the representation and counseling of government entities, private sector companies and their leadership and staff. He has worked as an attorney both in government and in international law firms and also served as a senior executive, advising on and handling a broad range of commercial, infrastructure, finance, outsourcing, in-sourcing, legislative and regulatory matters.

Prior to resuming his law practice in 2015, he was for five years the Executive Vice President of MTA-NYC Transit. In that role, he was involved with all aspects of the operations of the nation’s largest transit agency, including protection and restoration of service during hurricanes Irene and Sandy. He also had line responsibility for a dozen of the agency’s support divisions, including procurement, budget, human resources and planning, among others.

Bob also served as General Counsel and Secretary to the Board of the MTA and, before that, of Metro-North Commuter Railroad, an MTA subsidiary. During this 11-year tenure with the MTA, he managed legal and claims staff, directly handled litigation and major transactions, and was the chief legal advisor to senior executives and the Boards of Directors.

As a partner in two large international law firms, Bob represented state governments, municipalities and public agencies across the U.S. and domestic and foreign companies in matters affecting all modes of transportation, and handled matters respecting federal and municipal park concessions, ethics, corporate mergers and acquisitions, regulatory matters, litigation, and appeals. Specifically, he handled contracting for equipment, services and construction, including public-private partnerships and design-build-operate-maintain arrangements, procurement, valuations, legislative and regulatory drafting, litigation, appeals, arbitrations, and internal investigations.

Throughout his legal career, Mr. Bergen has been a speaker, moderator or presenter at many conferences on a wide range of subjects.  He has been active as a member and a chair at the Bar Association of the City of New York, at the American Public Transportation Association and at the National Academy of Sciences, Transportation Research Board.
